Medical negligence claims on behalf of people with disabilities

The quality of care in the NHS and social services for people with learning disabilities is at best patchy and at
worst an indictment of our society” -
Ann Abraham, Health Service Ombudsman

“If she had been a normal young woman, we would not hesitate to treat her”
– Health Professional to family of
child with a learning disability, as reported in Mencap’s Report, Death by Indifference

Negligent medical treatment can happen to anyone, but unfortunately it occurs with alarming frequency to people with learning disabilities.

One example is a man with a learning disability who was admitted to hospital following a stroke and died a month later as a result of not being given proper nutrition. Mencap investigated the death and concluded:

“We believe that the real, underlying cause of Mark’s death – and those of many other people with a learning
disability who die in hospital – is the widespread ignorance and indifference throughout our healthcare services
towards people with a learning disability, and their families and carers.”
